ALL PLAINTIFFS' CASES ARE HANDLED ON CONTINGENT FEE AGREEMENTS

On all of our plaintiffs' cases, if the case is settled, or we obtain a judgment in our client's favor, we receive an agreed percentage as our attorney's fee. If the case is lost, or we do not recover any money by settlement, our client owes us nothing.

TYPES OF CASES WE HANDLE

VEHICLE ACCIDENT CASES:

AL SCHALLAU has handled vehicle accident cases representing plaintiffs since 1969. He has dealt with virtually all of the major auto insurance companies, most of them more than once. His first job is to negotiate a maximum settlement for his client. But if the case cannot be settled, he is ready, willing, and able to take the case to a jury trial or arbitration hearing. He has done that many times.

TRAILER ACCIDENTS INVOLVING U-HAUL AND OTHER TRAILERS:

AL SCHALLAU is an expert in handling accident cases involving U-Haul trailers and other trailers that swung out of control on streets and highways, causing severe injuries and/or accidental deaths. The highway patrol reports always blame the drivers. But those accidents are rarely the fault of the drivers. AL SCHALLAU has developed an enormous library of materials relating to trailer accidents, and has unique experience in handling such cases effectively.

PRODUCTS LIABILITY CASES:

One insurance claims adjuster once told AL SCHALLAU, "Show me 100 industrial accidents, and I will show you 40 products liability cases."

Since 1972, AL SCHALLAU has been handling products liability cases involving defective products that caused severe injuries to industrial workers, vehicle drivers and passengers, innocent bystanders, and other persons.

Mr. Schallau has handled dozens of products liability cases representing plaintiffs, and has unique experience and expertise in handling such matters. He is frequently associated as co-counsel by other law firms to handle their products liability cases.

LEGAL MALPRACTICE CASES:

Since 1982, AL SCHALLAU has handled legal malpractice cases representing plaintiffs. He has also served as an expert witness in legal malpractice cases since 1985. He has testified in court and/or had his deposition taken as an expert witness in cases filed in Superior Courts of Los Angeles, Orange, and San Francisco counties.

At the AL SCHALLAU LAW FIRM, we represent plaintiffs whose prior attorneys failed to handle their personal injury lawsuit or industrial machinery accident claim properly. Such malpractice claims can be based on a lawyer's incompetence, inexperience, inaction, misrepresentations, or other errors and omissions. Examples:

Failure to file a lawsuit within the statute of limitations time.

Failure to recognize viable claims for damages (usually products liability).

Failure to file required documents in timely fashion.

Failure to refer a case to a specialist or more experienced attorney.

Misrepresentations to a client, or concealment of vital information from client.

We do NOT take all types of legal malpractice cases. We limit ourselves to the areas of law that we know best – (personal injury, products liability, and industrial machinery accidents). On those types of cases, we are able to identify critical mistakes and/or omissions made in the handling or mishandling of plaintiff's case.

Meritorious damage claims related to industrial machinery accidents can easily be missed by lawyers who are not experienced or lack knowledge concerning unsafe, unguarded, or otherwise defective products.

Many lawyers believe that a worker injured on the job can only recover workers compensation benefits. That is NOT true. That worker might well have a valid products liability claim for damages. It is the lawyer's job to identify that claim, and if he or she does not, there is potential legal malpractice involved.

CIVIL APPEALS PRACTICE:

The AL SCHALLAU LAW FIRM has represented appellants and respondents in civil appeals in personal injury litigation since 1972. Mr. Schallau has obtained reversals of judgments entered against plaintiffs, and has obtained affirmances of judgments where he was representing the respondents on appeals filed by the defense side.

From 1972 to the present, AL SCHALLAU has drafted more than 200 appeal briefs that have been filed in State and Federal courts. In 1984 and 1985, the California Trial Lawyers Association hired AL SCHALLAU as an Amicus Curiae brief drafter, and he thereafter wrote appeal briefs that were filed in the California Supreme Court on some very important cases, which are listed in the "Past Settlements and Judgments" section of this website.
